Terms of use

These terms govern HitClash, music battles, challenges, the community feed, and HitClash Premium. They are written to be understood before you use the service.

Publisher and acceptance

HitClash is published by mcsEdition, 1283 avenue Bourdages Nord, Saint-Hyacinthe, Québec J2S 5P7, Canada. Contact: contact@mcsedition.org. By installing, opening, or using HitClash, you accept these terms and the privacy policy.

If you cannot legally accept a contract on your own in your country, your parent or legal guardian must authorize your use. Mandatory consumer rights remain in force and are not limited by these terms.

What HitClash provides

HitClash lets you create music tournaments with 4 to 64 tracks, compare songs, view a bracket, keep results, publish a verdict, react, import a compatible playlist, and send a challenge to a friend. Some features require internet access, a compatible device, or permission from a music service.

HitClash is not a full music streaming service. Previews, artwork, titles, and listening links come from third-party catalogues and may change, disappear, or be unavailable in some countries.

Technical account and public profile

An anonymous technical identity may be created to secure challenges, reactions, and purchases. To post in the feed, you choose a display name and a unique public handle. The public handle is locked after creation to reduce impersonation and confusion.

You are responsible for activity from your device and for keeping shared links private when needed. Tell us promptly if you believe access has been misused.

Feed, posts, and conduct

The feed is a public space for music opinions. You keep your rights in your content. By posting, you give mcsEdition a worldwide, non-exclusive, royalty-free permission to host, reproduce, adapt to screen formats, and display the post only to operate and promote HitClash. This permission ends when the content is deleted, subject to backups and legal obligations.

  • Do not post illegal, hateful, threatening, sexual, deceptive, or rights-infringing content.
  • Do not use another person’s name, photo, or identity without permission.
  • Do not spam, automate reactions, or manipulate results or visibility.
  • Do not bypass security, scrape data at scale, or disrupt the service.
  • Use reporting and blocking tools when content causes a problem.

Moderation and removal

mcsEdition may limit, hide, or remove a post, handle, or access where there is a user safety risk, a breach of these terms, a legal request, or abusive use. Where reasonably possible, the action will be proportionate to the issue.

To report content or challenge an action, use the controls in the app or email contact@mcsedition.org with the post link or identifier.

Music catalogues and artist rights

Artist names, track titles, artwork, trademarks, and previews belong to their respective owners. Their presence does not mean an artist endorses HitClash. HitClash provides a comparison interface and links to authorized services for listening.

You must follow the terms of Apple Music, iTunes, YouTube Music, and any other connected service. You may not record, redistribute, download, or bypass protection on music content through HitClash.

HitClash Premium, trials, and renewal

  • The price, billing period, currency, trial, and purchase conditions shown at checkout come directly from your device’s app marketplace and take priority.
  • A subscription renews automatically unless cancelled in marketplace settings before the date shown there.
  • Trial eligibility depends on the account used for purchases and the subscription group. A previously used trial may not be offered again.
  • Deleting HitClash does not cancel a subscription. Cancellation takes place in your device’s app marketplace.
  • Refunds, taxes, and payment methods are handled by the marketplace under its rules and mandatory consumer law.
  • Restore purchases can recover access tied to the same purchase account where the available records allow it.

Free version and advertising

The free version may display advertising. Frequency and format may change. Where law or the operating system requires it, personalized advertising tracking depends on your choice. Refusing tracking does not necessarily stop non-personalized ads.

Availability, changes, and shutdown

We work to keep HitClash fast and available but do not promise uninterrupted availability. Maintenance, outages, catalogue restrictions, API changes, or marketplace decisions may interrupt a feature.

We may improve, replace, or remove a feature. If a material change affects an active subscription, we will follow marketplace rules and applicable consumer rights.

Responsibility

HitClash is provided for entertainment. Rankings and comparisons reflect personal choices and are not an objective measure of an artist or track. To the extent permitted by law, mcsEdition is not responsible for loss caused by a third-party service, an unavailable connection, a publicly shared link, or use that breaches these terms.

Nothing in these terms excludes liability that cannot legally be excluded or limits mandatory consumer warranties.

App marketplace terms

Your licence is personal, limited, revocable, non-transferable, and restricted to devices and uses authorized by the marketplace. mcsEdition is responsible for HitClash, maintenance, and support. The marketplace is not responsible for claims relating to the service except where its own terms or the law require otherwise.

Apple and its subsidiaries are third-party beneficiaries of the terms that concern them and may enforce those terms. You confirm that you are not located in a country subject to an applicable embargo and are not listed as a prohibited party. Store and third-party service terms also apply.

Stopping use, governing law, and contact

You may stop using HitClash at any time. You can delete feed posts in the app and request deletion of service data. Stopping use does not automatically cancel a subscription purchased through the marketplace.

These terms are governed by the applicable laws of Quebec and Canada without taking away mandatory protections in a consumer’s country of residence. Contact us first so we can try to resolve a dispute. The competent court is determined by mandatory applicable rules.
